New Personal Injuries Guidelines

The Judicial Council of Ireland has approved the adoption of new Personal Injuries Guidelines.

Once enacted by legislation, these Guidelines will replace the existing Book of Quantum used by the Personal Injuries Assessment Board (PIAB), when assessing injury claims.

Going forward Judges will be obliged to have regard to these new Guidelines when assessing personal injury claims and it is widely expected that awards being made will reduce. 

The Minister for Justice has indicated that, once enacted, the Guidelines will apply to all applications before the PIAB, other than those where an assessment has been made. Therefore, it seems the Book of Quantum will continue to apply to claims already assessed by the PIAB or where court proceedings have begun.

A date for commencement of the new Guidelines has not yet been confirmed but is expected very shortly.
