How do I get a Divorce
In Ireland, we presently have a ‘no-fault’ system, which means there does not have to be misconduct by either spouse in order to be granted a Divorce. However, there are certain conditions that you must meet to get a decree of Divorce, these are:-
- When divorce proceedings begin, the spouses must have lived apart for at least two of the preceding three years.
- There must be no reasonable prospect of reconciliation between the spouses.
- There must be ‘proper provision’ for spouses and dependent family members.
- Any other conditions that the court deems necessary or appropriate.
Before you can apply for a Divorce, we, as your Divorce Solicitors, are legally required to discuss with you:-
- The possibility of resolving the difficulties in your marriage.
- Reaching a negotiated agreement, with the help of a Mediator.
- Finalising a legal separation by agreement, in writing.
- Finalising a legal separation by way of a Court Order.
